User Agreement

1. General Provisions

1.1. tunservice.by offers Internet users (hereinafter, the "User") the opportunity to use its services under the terms of this User Agreement (hereinafter, the "Agreement", the "User Agreement"). This Agreement enters into force from the moment the User expresses consent to its terms in accordance with clause 1.4 of this Agreement.
1.2. tunservice.by provides Users with access to services, including uploading, analysis and modification of files. All services currently available, as well as their development and/or the addition of new services, are subject to this Agreement.
1.3. The use of the tunservice.by services is governed by this Agreement, the Privacy Policy and the terms of use of specific services. This Agreement may be amended by tunservice.by without notice, and the new version of this Agreement enters into force from the moment it is posted on the Internet at the address specified in this clause, unless otherwise provided by the new version of the Agreement. The current version of the User Agreement is always available at https://tunservice.by/user-agreement.
1.4. By starting to use any services / specific features or by completing the registration procedure, the User is deemed to have fully accepted the terms of this Agreement without any reservations or exceptions. If the User does not agree with any provisions of this Agreement, the User must not use the tunservice.by services. If tunservice.by makes changes to this Agreement in accordance with clause 1.3 of this Agreement that the User does not agree with, the User must stop using the tunservice.by services.

2. Purpose of processing users' personal data

2.1. To use certain tunservice.by services or specific service features, the User must complete registration in order to create a unique account.
2.2. When registering, the User must provide accurate and complete information requested in the registration form and must regularly update such information. If the User provides inaccurate information or if tunservice.by has grounds to believe that any information provided by the User is incomplete or invalid, tunservice.by may, at its discretion, block or delete the User's account or prohibit the User from using any services (or specific features).
2.3. tunservice.by reserves the right at any time to require the User to confirm the information provided during registration and to request supporting documents. Failure to comply with these requirements may be treated by tunservice.by as the provision of invalid information and result in the consequences set out in clause 2.2. If the User's data indicated in the documents provided by the User does not correspond to the information provided during registration, or if the information provided during registration does not allow the User to be identified, tunservice.by reserves the right to deny the User access to their account and the use of the tunservice.by services.
2.4. Any personal information of the User contained in the User's account will be stored and processed by tunservice.by in accordance with the Privacy Policy (https://tunservice.by/privacy-policy).
2.5. Methods of accessing the User's account.
- 2.5.1. When registering, the User must provide a valid email address (which is used as the login). tunservice.by may prohibit the use of certain logins and set other requirements for the login (length, allowed characters, etc.).
2.6. The User is responsible for the security of the means chosen to access their account and for maintaining the confidentiality of such means. The User is responsible for any actions (and their consequences) performed in the tunservice.by services through their account, including the voluntary transfer by the User of information required for accessing the User's account to third parties under any conditions (including under contracts or agreements). Any actions in the tunservice.by services performed through the User's account are deemed to be performed by the User, except where the User, as provided for in clause 2.7 of this Agreement, notifies tunservice.by of unauthorized access to the tunservice.by services through their account and/or any other breach (suspected breach) of the confidentiality of the means chosen to access their account.
2.7. The User shall promptly inform tunservice.by of any cases of unauthorized (not permitted by the User) access to the tunservice.by services through their account and/or any breach (suspected breach) of the confidentiality of the means chosen to access their account. For security reasons, the User must securely log out after completing each session ("Log out" button) when using the tunservice.by services. tunservice.by is not liable for any possible loss or damage to information, as well as for any other consequences resulting from the User's failure to comply with this part of the Agreement.
2.8. Use of the User's account.
- 2.8.1. The User may not reproduce, copy, sell, resell or use for commercial purposes any parts of the tunservice.by services (including content available to the User through the services) or access to the tunservice.by services, unless tunservice.by has given permission for this or it is directly provided for in the user agreement for a specific service.
- 2.8.2. Certain categories of user accounts may restrict or prohibit the use of specific tunservice.by services or some of their features if this is required by the registration or user terms governing such services.
2.9. Termination of the account.
- 2.9.1. tunservice.by may block or delete a User's account, and also prohibit access via any account to certain tunservice.by services, and delete any content without explanation, including in cases of violation by the User of the terms of this Agreement and the terms of any documents listed in clause 1.3 of this Agreement, as well as in case of non‑use of a service.
2.10. Deletion of the User account.
- 2.10.1. The User may at any time delete their account for all tunservice.by services or, if such an option is available, terminate the account with respect to specific services. To delete an account, the User must send a request to support: support@tunservice.ru.

3. General conditions of use and storage

3.1. tunservice.by may impose restrictions on the use of the services for all Users or for certain categories of Users (depending on the User's location, the language of the service, etc.), including: availability/unavailability of specific service features, the period for storing tasks or files and any other content, the maximum number of tasks or files for a single registered User, the maximum file size or disk space, the maximum number of uses of the services within a certain period, the maximum period for storing content, specific parameters of uploaded content, etc. tunservice.by may prohibit automated requests to its servers and may stop accepting any automatically generated information.
3.2. tunservice.by may send informational messages to its Users.

4. User content

4.1. The User is responsible for the compliance of any content they post with applicable law, including liability to third parties if the posting by the User of any content or its content violates the rights and legitimate interests of third parties, including personal non‑property rights of authors, any other intellectual rights of third parties and/or encroachments on other objects of intellectual property.
4.2. The User acknowledges and agrees that tunservice.by may use the User's content at its discretion and may reproduce the User's content in order to ensure compliance with the technical requirements of a particular service.

5. Terms of use of the tunservice.by service

5.1. The User is liable to third parties for any actions related to the use of the tunservice.by service, including any actions resulting in a violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the tunservice.by service.
5.2. When using the tunservice.by service, the User must not:
- 5.2.1. violate the rights of third parties, including minors, and/or cause harm in any way;
- 5.2.2. impersonate any other person or representative of an organization and/or community without proper authority;
- 5.2.3. assist in any actions aimed at circumventing the restrictions and prohibitions established by this Agreement;
- 5.2.4. otherwise violate legal norms, including international law.
5.3. To process files, the User must create processing tasks (hereinafter, the "Processing Task").

6. Exclusive rights to services and content

6.1. Any objects available through the tunservice.by services, including design elements, ECU files, text, graphics, illustrations, videos, software, databases and other objects (hereinafter, the service content), as well as any content posted on the tunservice.by services, are the exclusive property of tunservice.by, Users and other right holders.

7. No warranties, limitation of liability

7.1. The User uses the tunservice.by services at their own risk. The services are provided "as is". tunservice.by bears no liability, including for the conformity of the services to the User's purposes.
7.2. tunservice.by does not warrant that the services meet or will meet the User's requirements; that the services will be provided without interruptions, promptly, reliably and without errors; that the results obtained using the services are accurate and reliable and can be used for any purposes or in any capacity (for example, for identification and/or confirmation of any facts); that the quality of any product, service, information, etc. obtained through the services will meet the User's expectations.
7.3. Any information and/or materials (including ECU files, downloadable software, messages, any instructions and manuals, etc.) that the User accesses through the tunservice.by services may be used by the User at their own risk, and the User is responsible for any potential consequences of using such information and/or materials, including any damage to the User's or third parties' computers, any damage to the User's or third parties' vehicles, or any other damage.
7.4. tunservice.by is not liable for losses arising from the User's use of the tunservice.by services or individual parts/features of the services.
7.5. If the User has any claims regarding the quality of the tunservice.by services, the User must contact support by email at support@tunservice.ru.

8. Other provisions

8.1. This Agreement constitutes an agreement between the User and tunservice.by regarding the procedure for using the services and supersedes all prior agreements between the User and tunservice.by.
8.2. Nothing in this Agreement shall be construed as establishing an agency, partnership, joint activity, employment relationship or any other relationship not expressly provided for in this Agreement.
8.3. If for any reason one or more provisions of this Agreement are held invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.
8.4. Failure by tunservice.by to act in case of a breach by the User or other users of the provisions of this Agreement does not deprive tunservice.by of the right to take measures to protect its interests in the future and shall not be regarded as a waiver by tunservice.by of its rights in case of any future similar or identical breaches.

9. Refund policy

9.1. The maximum period within which the User may submit a claim regarding the quality of file processing is 30 days. This period starts from the moment the order is paid. This period is calculated separately for each Processing Task and is not transferred to other Processing Tasks.
9.2. To submit a claim, the User must send an email to support@tunservice.ru from the email address used by the User in their account. The User acknowledges and agrees that claims are not accepted if they are not sent to support@tunservice.ru from the email address used by the User in their account.
9.3. The User must provide detailed information in the claim regarding the issues with the Processing Task, including a description of the problem, photos, screenshots and any other information confirming the existence of the issue. At the request of tunservice.by, the User must provide any additional information about the problem.
9.4. The User acknowledges and agrees that tunservice.by has a priority right to correct the issues with the Processing Task specified by the User. The User must wait until tunservice.by corrects the problem or notifies the User that the problem cannot be corrected.
9.5. A refund may be issued only if all of the following conditions are met:
- 9.5.1. the conditions of clause 9.1 of this Agreement are met;
- 9.5.2. the conditions of clause 9.2 of this Agreement are met;
- 9.5.3. the conditions of clause 9.3 of this Agreement are met;
- 9.5.4. tunservice.by has acknowledged that there is a problem and has notified the User of this by email;
- 9.5.5. the conditions of clause 9.4 of this Agreement are met.

10. Payment for services

10.1. Payment for services using bank cards issued by non‑resident banks of the Russian Federation is carried out with the involvement of Limited Liability Company "Online Technologies" (Republic of Belarus), UNP 193725039, registered address: Republic of Belarus, 220088, Minsk, Zakharova St., 59, office 307.
10.2. The organization of placement and payment of the Order on the website is carried out by LLC "Online Technologies" on the basis of an agency agreement concluded with Sole Proprietor Zapadin A.A.
